Terms of Service

Welcome to RANDROOM. These Terms of Service ("Terms") govern your access to and use of the services provided by MoaiStudio ("we," "us," or "our"). By using our services, you agree to be bound by these Terms.

Section 1. Scope and Application

  1. These Terms define the relationship between MoaiStudio and users of our online tools.
  2. If specific guidelines or additional terms are provided for a particular tool, those terms shall supplement these Terms. In case of a conflict, the tool-specific terms will prevail.
  3. We provide service information and support in both Japanese and English.
  4. Minors or individuals with limited legal capacity must obtain consent from a legal guardian before using the service.

Section 2. Accounts and Registration

  1. To register, you must provide a nickname, email address, and password. Passwords are encrypted (hashed) for your security.
  2. You are responsible for providing accurate and up-to-date information. We reserve the right to suspend or deny access if false information is provided.
  3. Accounts are for personal use only and may not be transferred or shared. We are not liable for any damages resulting from inadequate account management.

Section 3. Guest Usage and Room Creation

  1. Users may create and use Rooms without an account. However, certain features are reserved for registered members or paid plans.
  2. Rooms created as a guest require an Admin Password for future editing or deletion.
  3. All Rooms, whether public or unlisted, are subject to these Terms.

Section 4. Paid Plans and Payments

  1. While we offer a free tier, certain premium features are available through monthly or annual paid plans. Pricing and features are displayed on the plan selection page.
  2. Payments are processed securely via Stripe. We do not store or see your full credit card information.
  3. Paid plans are billed on the day of purchase and renew automatically.
  4. You may cancel your subscription at any time before the next billing cycle. Due to the nature of the Service, fees are non-refundable.
  5. Pricing and plan details are subject to change with prior notice.

Section 5. Prohibited Conduct

Users are prohibited from engaging in the following activities:

  1. Violating any laws, regulations, or public order.
  2. Infringing upon the rights, property, or privacy of MoaiStudio, other users, or third parties.
  3. Unauthorized access, distribution of malware, or interfering with the system’s integrity.
  4. Impersonation or fraudulent use of accounts and Rooms.
  5. Infringing on intellectual property rights, including copyrights and trademarks (we respond to valid DMCA notices).
  6. Posting or sharing content that is violent, obscene (including child pornography), discriminatory, criminal, or harassing.
  7. Unauthorized commercial use, including spamming, advertising, or solicitation.
  8. Reverse engineering, decompiling, or analyzing the service’s source code.
  9. Imposing an excessive load on our servers or disrupting service operations.
  10. Any other conduct deemed inappropriate by us.

Section 6. Intellectual Property

  1. All programs, images, text, and trademarks associated with our services belong to MoaiStudio or its licensors.
  2. Unauthorized reproduction, distribution, or modification of our content is strictly prohibited.

Section 7. Data and Privacy

  1. We collect access logs, registration data, and payment information as detailed in our Privacy Policy.
  2. We use cookies to maintain login states and for performance analytics and advertising.

Section 8. Personal Information

  1. We handle personal information in accordance with our Privacy Policy.
  2. By using our services, you consent to the data practices described in the Privacy Policy.

Section 9. Service Changes and Suspension

  1. We may modify or suspend parts of the service for maintenance, legal compliance, or force majeure events without prior notice.
  2. We are not liable for any damages caused by such service changes or interruptions, except in cases of willful misconduct or gross negligence.

Section 10. Disclaimer and Limitation of Liability

  1. The service is provided "as is" without any warranties of accuracy, reliability, or fitness for a particular purpose.
  2. MoaiStudio is not liable for any damages resulting from the use or inability to use the service, except where required by law.
  3. In any event, our total liability shall be capped at the total amount paid by the user for the service during the 12 months preceding the claim. If you are using the free tier, we are exempt from liability to the extent permitted by law.

Section 11. Governing Law and Jurisdiction

These Terms are governed by the laws of Japan. Any disputes shall be subject to the exclusive jurisdiction of the Tokyo District Court in the first instance.

Section 12. Governing Language

The authentic version of these Terms is written in Japanese. This English translation is provided for your convenience only. In the event of any conflict or inconsistency between the Japanese version and this translation, the Japanese original shall prevail.

Section 13. Geographic Restrictions

The Service is intended for use by individuals and entities located outside the European Economic Area (EEA) and the United Kingdom. We do not intend to offer goods or services to, or monitor the behavior of, residents or entities located in the EEA or the UK. Access to the Service and entering into contracts for paid subscriptions from these regions is strictly prohibited. We reserve the right to terminate access or delete data for any user found to be in violation of these restrictions.
